Please review these Terms and Conditions of Service (Terms
of Service) of the FindAPilot.com. website (the Web
Site). Your access to and use of this Web Site is subject to your acceptance of
the Terms of Service and to all applicable laws.
THE TERMS, CONDITIONS, AND NOTICES BELOW WILL GOVERN YOUR
USE OF FINDAPILOT.COM. THEY ALSO PROVIDE NOTICE OF SOME OF FINDAPILOT.COM"
POLICIES. PLEASE READ THEM CAREFULLY!
If your profile, or resume is in our Database You Agree to
be CONTACTED by e-mail, telephone, mail, or other means necessary by FindAPilot to verify accuracy of listings, billing, email newsletters and marketing, etc. If
you do not wish to be contacted please remove your profile or resume from FindAPilot.com.
Pilots posting profiles understand that any information added to their profile
is their responsibility. FindAPilot blocks the
following information to employers and public viewers for your protection:
email address and home address. Any other information placed by the pilot is at their own risk. This information includes, but
is not limited to: phone numbers, email addresses, certificate numbers, photos,
resumes, or any other information supplied by the user.
REFUND POLICIES
You understand that the FindAPilot.com service will commence
as soon as FindAPilot.com receives and processes your initial payment. Pilot
membership is recurring billing (monthly and yearly). You agree that any
statutory right to withdraw from the FindAPilot.com service will be waived as
soon as the FindAPilot.com service commences. If you cancel your FindAPilot.com
within 3 business days from date of purchase or recurring billing date,
FindAPilot.com will provide a full refund. If however, you cancel your
FindAPilot.com account thereafter you will not be entitled to any refund of
fees.
All Employers, Job Seekers and/or Recruiters creating an
account on FindAPilot.com at any time may remove their profile information and
cancel their account on FindAPilot.com. Cancellation is immediate, and user can
request site access up to their monthly or annual billing date.
No website may take and/or reproduce job listings on
FindAPilot.com for any reason without written permission from FindAPilot.com.
No website may frame FindAPilot.com , take and/or
reproduce or any of its job listings on FindAPilot.com for any reason without
written permission from FindAPilot.com. A $50,000 per day fine will be assessed
to the website for each job that is linked to or framed by a website.
You may not sell or modify the FindAPilot.com content or
reproduce, display, publicly perform, distribute, or otherwise use the
FindAPilot.com content in any way for any public or commercial purpose. The use
of the FindAPilot.com content on any other web site or in a networked computer
environment for any purpose is prohibited. You shall not copy or adapt the HTML
code that the Company creates to generate any FindAPilot.com content or the
pages making up any FindAPilot.com Site which is also
protected by the Company's copyright.
FindAPilot.com will regularly update and enhance the Web
Site and may, from time to time, revise the Terms of
Service and Privacy Policy. Use of FindAPilot.com is governed by the Terms of
Service and Privacy Policy posted at the time of use, it is your obligation to
check the Terms of Service and Privacy Policy pages each time you access and
use the Web Site.
NO GUARANTEE FindAPilot.com does not
guarantee any specific results from use of the services on the Site.
FindAPilot.com is offered to you, the user, only
conditioned on your acceptance without modification of the terms, conditions,
and notices contained herein. "FindAPilot.com" also refers to all
information, text and visual images, software, products and services used or
available via FindAPilot.com. Any and all rights not expressly granted in these
Terms, Conditions and Notices (collectively, these
"Terms") are reserved by FindAPilot.com. FindAPilot.com
reserves the right to change these Terms, at its sole discretion, at any time
or from time to time. Your use of FindAPilot.com means that you have read all
of these Terms and agree to them. For further information relating to the legal
issues contained in these Terms or problem reports regarding this service,

Support at 1-888-765-2825. The information provided is based upon information
collected from employers and/or other sources by FindAPilot.com. Although
believed to be correct, FindAPilot.com makes no guarantees concerning the
accuracy of this information.
Other Parties. FindAPilot.com may contain hyperlinks or
other connections to Web sites operated by parties other than FindAPilot.com,
including but not limited to those of FindAPilot.com’s
Member companies and agencies or its advertisers (individually or collectively,
as the case may be, "Members"). FindAPilot.com does not control these
Web sites and is not responsible for them, including for their availability,
content or any viruses accessed through them. FindAPilot.com’s
inclusion of hyperlinks or other connections to such Web sites does not imply
any endorsement of the material on them or any association with their owners or
operators. FindAPilot.com takes no responsibility whatsoever for the activities
of job applicants or FindAPilot.com Members or those Members’ respective
hiring, recruiting or other practices (or any of the information posted or
downloaded by them on FindAPilot.com). Nothing on FindAPilot.com shall be
deemed to be an endorsement, representation or warranty with respect to any
Member, applicant or other third party, whether in regard to its Web site,
products, services or otherwise.

information regarding the manner in which you use FindAPilot.com. While the use
of our privacy features should provide you with a degree of control over the
distribution of information you submit, FindAPilot.com cannot guarantee that
your information will be prevented from being viewed by any particular party.
If you have directly submitted information and you want to
remove it, and you are unable to remove it yourself, and would like us to
remove it from our database, please contact us at Support@FindAPilot.com and we
will use reasonable efforts to help you delete your information from our then
existing files.

PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO
WARRANTIES OF TITLE, NON-INFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE. NO ADVICE OR INFORMATION GIVEN BY
FINDAPILOT.COM, ITS AFFILIATES OR THEIR RESPECTIVE EMPLOYEES SHALL MODIFY THE
FOREGOING OR CREATE ANY WARRANTY. FINDAPILOT.COM EXPRESSLY DISCLAIMS ANY
WARRANTY THAT THE INFORMATION ON FINDAPILOT.COM OR ON THE INTERNET GENERALLY
WILL BE UNINTERRUPTIBLE OR ERROR FREE OR THAT ANY INFORMATION, SOFTWARE OR OTHER
MATERIAL ACCESSIBLE FROM FINDAPILOT.COM IS FREE OF VIRUSES OR OTHER HARMFUL
COMPONENTS. YOU SHALL HAVE ABSOLUTELY NO RECOURSE AGAINST US AS THE SYSTEM
PROVIDER FOR ANY ALLEGED OR ACTUAL INFRINGEMENT OF ANY PROPRIETARY RIGHTS YOU
MAY HAVE IN ANYTHING YOU POST ON FINDAPILOT.COM. WE MAKE NO WARRANTIES
WHATSOEVER THAT YOU WILL OBTAIN neither ANY JOB VIA FINDAPILOT.COM, NOR ANY
WARRANTIES ABOUT (AND TAKE NO RESPONSIBILITY FOR) ANY JOB YOU MAY OBTAIN. You
agree to indemnify and hold FINDAPILOT.COM, its subsidiaries, affiliates,
officers, agents and other partners and employees, harmless from any loss,
liability, claim or demand, including reasonable attorney's fees, made by any
third party due to or arising out of Your use of the Site, including also your
use of the Site to provide a link to another Site or to upload content or other
information to the Site.
FINDAPILOT.COM DOES NOT ASSUME ANY LEGAL LIABILITY OR
RESPONSIBILITY FOR THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY
INFORMATION, APPARATUS, PRODUCT, SOFTWARE OR PROCESS USED OR DISCLOSED ON
FINDAPILOT.COM OR ANY OTHER MATERIAL ACCESSIBLE FROM FINDAPILOT.COM. IN NO
EVENT SHALL FINDAPILOT.COM. BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE,
INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY
CONNECTED WITH THE USE OF FINDAPILOT.COM OR WITH THE DELAY OR INABILITY TO USE
IT (OR ANY LINKED SITES), OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS AND
SERVICES OBTAINED THROUGH FINDAPILOT.COM, OR OTHERWISE ARISING OUT OF THE USE
OF THIS OF FINDAPILOT.COM, THE INTERNET GENERALLY OR ON ANY OTHER BASIS
(WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE), EVEN IF
FINDAPILOT.COM HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE
EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES,
THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF THIS LIMITATION OF LIABILITY OR
THE EXCLUSION OF WARRANTY SET FORTH ABOVE IS HELD INAPPLICABLE OR UNENFORCEABLE
FOR ANY REASON, THEN FINDAPILOT.COM’S MAXIMUM LIABILITY FOR ANY TYPE OF DAMAGES
SHALL BE LIMITED TO U.S. $600.00 (SIX HUNDRED DOLLARS).
Miscellaneous.
No Partnership, etc. You agree that no joint venture,
partnership, employment or agency relationship exists between you and
FindAPilot.com (or any of FindAPilot.com Members) as a result of this agreement
or your use of this FindAPilot.com.
Certain Legal Requirements. FindAPilot.com's performance of these terms and conditions
is subject to existing laws and legal process, and nothing contained in them
will diminish FindAPilot.com's right to comply with
law enforcement requests or requirements relating to your use of FindAPilot.com
or information provided to or gathered by FindAPilot.com with respect to such
use.
Agreement. These terms represent the entire binding
agreement between us, and our respective successors and assigns, and supersede
any and all prior understanding, statements or representations, whether
electronic, oral or written, regarding FindAPilot.com, its FindAPilot.com or the
information thereon. A printed version of this Agreement and of any notice
given in electronic form shall be admissible in judicial or administrative
proceedings based upon or relating to this agreement to the same extent and
subject to the same conditions as other business documents and records
originally generated and maintained in printed form.
Certain Rights & Obligations;
Modification. FindAPilot.com shall have the right to terminate your
ability to access this service at any time without notice and to discontinue or
modify any of the information contained on this service, or the service, at any
time. FindAPilot.com shall have the right to modify these terms and conditions
at any time. The user may not assign any part of this Agreement without FindAPilot.com
prior written consent. No waiver of any obligation or right of either party
shall be effective unless in writing, executed by the party against whom it is
being enforced.
Enforcement, Interpretation, etc.
These terms shall be governed by the laws of the State of Texas and relevant
federal laws, and irrevocable consent is hereby granted by both parties to the
exclusive jurisdiction and venue for any action or dispute in the state and
federal courts located in the State of Texas, U.S.A. Use of this FindAPilot.com
is unauthorized in any jurisdiction that does not give effect to all provisions
of these terms and conditions, including without limitation this paragraph.
Notwithstanding the foregoing sentence, these terms shall be severable and
construed to the extent of their enforceability in light of the parties' mutual
intent if deemed at all unenforceable by a competent court. Given the nature of
these terms, you understand and agree that, in addition to money damages,
FindAPilot.com will be entitled to equitable relief upon a breach of them by
you.
